Ryde Scooters LLC Rental Agreement, Waiver of Liability and Release
Please review this Agreement carefully as it outlines the legally binding terms and conditions for your use of Ryde Services. By using any of the Ryde Services (as defined herein) provided by Ryde Inc. (“Ryde”), you agree to all terms and conditions contained in this Ryde Rental Agreement, Waiver of Liability, and Release (“Agreement”), on behalf of yourself, Rider’s family, heirs, agents, affiliates, representatives, successors, and assigns.
Ryde Services include:
1. The Ryde mobile application (the “Ryde App”) and the Ryde website, https://www.rydescootersllc.com (the “Ryde Site”).
2. Ryde Electric Vehicles (“Vehicle” or “Vehicles”).
3. All other related equipment, personnel, services, applications, websites, and information provided or made available by Ryde (collectively, the “Ryde Services”).
In addition to the Terms of Service, located at https://www.ryderyde.com/terms-and-conditions, which you expressly agreed to upon signing up for Ryde Services, please carefully read this Agreement in its entirety. THIS AGREEMENT CONTAINS RELEASES, DISCLAIMERS, ASSUMPTION-OF-RISK PROVISIONS, AND A BINDING ARBITRATION AGREEMENT THAT LIMIT YOUR LEGAL RIGHTS AND REMEDIES. FOR MORE DETAILS, PLEASE REFER TO SECTIONS 9 AND 15 BELOW.
Ryde expressly permits the rental of the Vehicle, and the Rider expressly agrees to accept it subject to the terms and conditions set forth herein. Unless otherwise indicated, all monetary values in this Agreement are denominated in U.S. dollars.
1. GENERAL RENTAL AND USE OF VEHICLE.
1.1 Sole Rider Responsibility.
Ryde and the Rider are the exclusive parties to this Agreement. The Rider is the sole renter and assumes full responsibility for compliance with all terms and conditions herein. When activating a Vehicle, the Rider agrees to use it exclusively and not permit others to use the activated Vehicle.
1.2 Rider Age Requirement.
Rider certifies to be at least 18 years old. Persons under 18 are prohibited from using or accessing Ryde Services.
1.3 Competent Vehicle Operation.
Rider confirms familiarity with Vehicle operation and certifies physical fitness for riding. By riding a Vehicle, Rider assumes all risks detailed in Section 15 of this Agreement, including responsibility for injuries, medical conditions, and property damage during Ryde Service use. Rider must assess weather and environmental conditions to adjust riding behavior safely.
1.4 Vehicle Ownership and Modification.
Rider acknowledges that the Vehicle and all attached equipment remain Ryde's exclusive property. Rider must not modify, repair, or deface any part of the Vehicle or use it for commercial purposes without Ryde's written consent.
1.5 Vehicle Operating Hours and Availability.
Rider understands that Vehicles are not available 24/7. Rentals must comply with maximum time limits, and Vehicle availability is not guaranteed.
1.6 City-Limited Use.
Rider agrees to use and operate the Vehicle only within designated city limits.
1.7 Compliance with Laws and Safety.
Rider agrees to adhere to all Vehicle-related laws, including helmet regulations, and to operate the Vehicle safely and courteously toward others.
1.8 Prohibited Actions.
Rider agrees:
- Not to carry items that may compromise safe operation.
- Not to obstruct handlebars with objects.
- Not to use distracting devices while riding.
- Not to operate under the influence.
- Only one rider per Vehicle.
- No animals or pets on board.
- Only use Ryde-provided locks.
- Park the Vehicle legally and securely.
1.9 Limited Use Types.
Rider agrees not to use the Vehicle for racing, stunt riding, or on prohibited terrain, and not for hire or reward.
1.10 Weight and Cargo Restrictions.
Rider must not exceed the 300 lbs weight limit of the Vehicle.
1.11 No Unauthorized Use.
Rider must not tamper with or misuse Ryde Services.
1.12 Reporting Incidents.
Rider must promptly report accidents, damage, or theft to Ryde and file a police report within 24 hours as required.
1.13 Vehicle Condition upon Return.
Rider agrees to return the Vehicle in its rented condition, excluding normal wear and tear.
1.14 Electric Vehicle
This section details the usage and responsibility associated with operating an electric vehicle (EV) through the Ryde service. To ensure safe and proper usage, riders must adhere to certain guidelines and understandings:
- The electric charge level of the vehicle will naturally decrease during use, depending on factors such as time, distance, and speed. As this charge diminishes, the vehicle's performance capabilities may also decrease or cease entirely.
- The specific charge level of the vehicle at the start of each rental is not guaranteed and may vary.
- The rate at which the vehicle loses charge is variable, influenced by factors like road and weather conditions, as well as the rider's weight. This rate may differ between vehicles.
- It is the rider's responsibility to verify the charge level before commencing operation, ensuring it's adequate for their intended use.
- The range or duration a rider can operate the vehicle before depletion is not assured.
- The vehicle may lose power and stop functioning at any point during the rental period, including before its return.
1.15 Insurance
Ryde advises riders to verify with their automotive insurance provider if coverage extends to accidents or damages involving rental vehicles. It is the rider's responsibility to ascertain the extent of their coverage.
2. Payment and Fees
This section outlines the payment structure for using the Ryde service:
- Riders can access vehicles on a pay-per-ride basis, following the pricing details available on the Ryde App or Website. In the event of conflicting pricing information, the details on the Ryde Website shall prevail.
- All fees and charges are subject to applicable taxes and other local government levies, which Ryde will collect through the payment method on file (credit/debit card).
- Promo codes for discounts are single-use and redeemable only via the Ryde App. Ryde reserves the right to modify or discontinue discounts at its discretion.
- The maximum rental period for a vehicle is 24 hours, and riders must return the vehicle to its original rental location. Charges are capped at $50 per calendar day. Vehicles not returned within 48 hours may incur additional fees and be subject to a police report.
- A valid credit or debit card is required for registration. By providing card details, riders authorize Ryde to charge all applicable fees, including taxes.
- Additional fees may apply for pick-up services or if a vehicle is abandoned without notice.
- A refundable security deposit of $50 is charged upon rental, to be refunded upon the vehicle's return in its original condition.
3. Additional Terms of Use
This section covers additional terms to ensure safety and responsible usage:
- Riders must conduct a basic safety inspection before using a vehicle, checking wheels, brakes, lights, frame condition, battery charge, and any visible issues. If issues are identified, riders should not use the vehicle and must promptly inform Ryde's customer service.
- A vehicle may be deemed lost or stolen under various circumstances, and Ryde reserves the right to take appropriate action, including restitution and involving local authorities if necessary.
By understanding and agreeing to these terms, riders can enjoy the Ryde service responsibly and safely.
